Kota Kinabalu: The High Court adjourned to Aug 17 for clarification or ruling on the application for leave for judicial review filed by former Chief Minister Tan Sri Musa Aman and 32 assemblymen to challenge the Head of State’s decision for the dissolution of the State assembly.
High Court Judicial Commissioner Leonard David Shim also set Aug 9 for the Senior Federal Counsel acting for the Federal Attorney General's chambers and State Attorney General to file their respective written submissions on the justiciability issue.
He fixed Aug 12 for the applicants to submit their written reply submission.
Musa and 32 assemblymen named Head of State Tun Juhar Mahiruddin, caretaker Chief Minister Datuk Seri Mohd Shafie Apdal, the Election Commission and the State government as the first, second, third and fourth respondents respectively.
In the application filed on Aug 3, the applicants are seeking an injunction on the dissolution of the assembly and to question the July 29 written request from Shafie to Juhar seeking to dissolve the assembly.
